Affitu (Mobile App) is owned and operated by Dotmite Technologies private limited; all references to "Affitu", "app", "we", or "us", include Dotmite Technologies private limited. Affitu App provides this solution to assist owners and tenants in managing their rental property activities. You must first agree to the following terms and conditions (the "Rules of Use"), as well as the terms of our Privacy Policy, in order to receive the Service. If you do not agree to the Terms of Use, you may not use the Services. You can accept the Terms by clicking to accept or agree to the Terms in the user interface for any Service where this option is provided by Affitu; or by using the Services. In this instance, you acknowledge and agree that Affitu will treat your continued use of the Services as acceptance of the Terms.

User Access:
  • Please keep in mind that each user should only have one username and password. The username is the user's phone number. Before enabling an account, we have the right to check this information. If the account is discovered to be a broker account or for any other reason that we deem appropriate and for which it is not obligated to declare or justify, it may be refused or disabled.
  • You are solely responsible for any activities that occur under your password or account, with or without your knowledge, and for maintaining the secrecy of your password and account. We may suspend or terminate your account if you knowingly provide your login and password information to another person, in addition to any other remedies available to us. If you become aware of any unauthorized use of your password or account, or any other security breach, you must immediately tell us. We are not responsible for any loss or damage incurred as a result of your failure to follow this paragraph.
Registration Information:
  • When you register, we'll ask for your name, e-mail address, phone number, and a password of your choosing. Your contact number will be used as your username for login reasons, as previously stated.
  • You must give true, accurate, current, and complete registration information.
Profile Information:

Phone numbers (except where requested), obscene, lewd, excessively violent, harassing, sexually explicit, or otherwise objectionable subject matter, and any photographs containing nudity, profanity, or obscene, lewd, excessively violent, harassing, sexually explicit, or otherwise, objectionable subject matter are not permitted in your Affitu App profile. Despite this limitation, other users' information (for example, in their Profile) may contain erroneous, inappropriate, offensive, or sexually explicit material, products, or services, all of which violate these Terms of Use. We take no responsibility or accountability for this information. However, we encourage you to assist us in keeping the application clean by reporting any misuse of the Service to us.

E-mail Updates:
  • We may need to interact with you by e-mail as part of the Service (see our Privacy Policy. to learn more about communications).
  • You agree to receive e-mails that are specific to your account and required for the Service's normal operation, including one or more welcome e-mails that help new users learn about the Service's many features.
  • Unless users have requested not to receive these e-mails, we may send users periodic e-mail announcements. Product information, ideas, and comments may also be included in these e-mails.
Charges and Settlements:
  • Affitu doesn't charge any convenience fee for transactions as of now. However, you should note that we may begin to charge in the future for which we hold complete rights.
  • Affitu reserves the right to change, revise, increase, or decrease the convenience charge or Service Charges at any time and without previous notice to the Customer. Affitu is not liable to you for any modification, pricing change, suspension, or discontinuance of the Service.
  • Please contact our support team at support@dotmite.com in the event of a transaction issue, payment failure, or overcharge/wrong convenience fee charge.
  • We will transfer the funds to the Owner's associated bank account once we receive the rent payments within T+2 business days, where T indicates the date of notification of the transaction's completion.
  • All problems involving late rent payment, excess rent payment, etc will be resolved solely between the Owners and the tenants, without the involvement of Affitu and/or the Payment System Providers.
  • The User willingly submits all confidential information (including name, credit/debit card details, e-mail address, and so on) at his or her own discretion and risk. If such information is misused by a third party or results in unsolicited messages from such third parties, Affitu has no control over or responsibility for such acts and accepts no accountability or liability for such actions.
  • Affitu wishes to advise the User not to disclose their credit card information, expiry date, CVV, or OTP details to anyone; Affitu never asks for such information from the "User" other than through automated and secure payment methods, and we shall not be liable for any such disclosure made by the "User" to anyone, even if they claim to be affiliated with Affitu.
  • Any issue between the parties (User/tenant and owner) will not be held against Affitu.
  • Affitu is not involved in any underlying transaction between the User, any other User, any third party, or any service providers. Affitu is not a bank and does not provide banking or other financial services. To provide the Service and handle the User's transactions, Affitu may enlist the help of one or more third parties (each a "Processor").
  • Affitu makes no payment guarantees on behalf of any registered User, other User, or Processor, and expressly disclaims all liability for any User or Processor's act or omission. Plus, Affitu is neither a lessor's or lessee's agent nor a registered user. Affitu serves simply as a mediator, facilitating payments between the paying registered users and the intended third-party recipients.
  • Affitu will not be held liable for any refunds if the User selects the incorrect owner or fills out and submits incorrect information while making a rent payment on the App.
Disputed Transactions:

If a user violates any of Affitu's or our connected payment partners' terms and conditions, Affitu maintains the right to freeze any payment that it deems suspicious or invalid until it is fully confirmed. And, we may take appropriate action in the event of any fraudulent transactions, in accordance with the agreed-upon terms of usage.

Refunds and Cancellation:
  • The user at Affitu is free to use the platform for remitting rental payments and is not bound by any contract that requires them to do so. Users must understand and admit that payments made into the bank account of the registered owner are irrevocable because the account is within the personal jurisdiction of that individual.
  • For successfully remitted rental payments, there will be NO REFUNDS or REVERSALS of any type.
  • However, any debits incurred as a result of the app's technical failure will be entirely repaid to the user. In this respect, a technical failure refers to a divergence from the standard payment process on our App without an acknowledgment to the user of the payment's successful remittance. In this scenario, the user will be repaid the full amount, including any service fees (if applicable), into his account without delay within 7 to 10 working days. Also, in some cases where Affitu suffers from a technical issue, we need the required time to refund the amount to the concerned account.
Your Information
Privacy Policy:
  • The terms of our Privacy Policy govern how we utilize your information.
  • Before you can use the app, you must agree to the Privacy Policy.
Your Registration Information:
  • We will require you to give the above-mentioned name and contact information in order to enable you with access to the App, and we may ask you to update or verify this information from time to time.
  • You promise to give truthful information and cooperate with any Affitu personnel by using the App.
Other Information You Provide:
What You May Provide:
  • If you are an owner, the App provides information about your property, and if you are a tenant, the App contains information about your rent data. In addition, you must include proper contact information.
  • We may require relevant information to verify that this App does not allow brokers or agents to post or seek anything.
Prohibited Conduct:
  • You represent and warrant that you will not do any of the following via the app or otherwise in connection with the service: attempt or assist anyone else in attempting to gain unauthorized access to the Affitu app service or its related systems or networks (including, without limitation, impersonation of another user or other use of a false identity or address to gain access to the application) use the app to violate any person's intellectual property rights (including, without limitation, using the app to violate the intellectual property rights of another user) send spam or other duplicative or unsolicited messages in violation of applicable laws; send or store infringing, obscene, threatening, libelous, or otherwise unlawful or tortious material, including material harmful to children or material infringing on third-party privacy rights send or store material containing software viruses, worms, trojan horses, or other harmful computer code, files, scripts, agents, or programs interfere with or disrupt the integrity or performance of any application; interfere with or modify or create derivative works based on the service or the content; create internet "links" to the app or "frame" or "mirror" any Content on any other server, wireless or internet-based device reverse engineer or access the service in order to (a) build a product that is competitive with the Service, (b) build a product that uses ideas, features, functions, or graphics that are similar to those of the service, or (c) copy any ideas, features, functions, or graphics included in the service.
Rights of Affitu:
  • For any real or suspected violation of these Terms of Use, Affitu reserves the right to immediately suspend or terminate your access to the Service. Affitu also reserves the right to use or disclose personally identifiable information about any person or entity suspected of using this App or any other component of the Service for any fraudulent purposes, harassment, or otherwise violating any law, rule, or regulation, or the rights of third parties, or engaging in any conduct that Affitu deems immoral.
  • By using the Service, you consent to our use or dissemination of any information you supply in any manner we consider appropriate or necessary if you are accused of engaging in any inappropriate conduct. Affitu reserves the right to terminate, disable or deny your account creation if it discovers that you are a broker or operating on behalf of a broker, or for any other reason it deems suitable and is not obligated to justify or elucidate the reason.

Termination of Access:
  • If you break any of the Terms of Service, or for any other reason Affitu deems appropriate, your access to the Service will be terminated, and Affitu will not be obligated to justify or clarify the reason. If this is the case, you will no longer be able to use the App.
General:
Your Property Data:
  • Apart from your own name and contact information, Affitu owns and retains all right, title, and interest in and to the Service, the application, and any technology or content contained in or made available through the Service, as well as any suggestions, ideas, enhancement requests, feedback, recommendations, or other information you may provide relating to the Affitu Service.
Your Data:
  • Affitu shall not be responsible or liable for the deletion, correction, destruction, damage, loss, or failure to store any information you submit via the App, and you, not Affitu, shall have responsibility for the correctness, quality, integrity, legality, authenticity, appropriateness, and intellectual property ownership or right to use of any information you submit via the App. For any infraction of these Terms of Use or any other cause that we deem appropriate, Affitu retains the right to deny access to, remove and/or discard your information from the App, or terminate your account without notice.
  • If your account is terminated, you will no longer be able to access or utilize data through the Service, and Affitu will have no duty to keep or forward any data that you have contributed.
Warranties; Disclaimers:
  • The service is offered "as is," and Affitu makes no representations or warranties about the Affitu service's performance, including its safety, quality, efficacy, commercial viability, or merchantability. In this case, you are solely responsible and liable. Affitu will not be liable for any losses resulting from the use or inability to use the Affitu Service, even if Affitu has been warned of the likelihood of such damages.
  • Affitu assumes no liability for any damages incurred as a result of any interaction between its users that occurs directly or indirectly through Affitu.
Limitation of Liability:
  • Affitu shall not be liable to any person for any incidental, consequential, special, indirect, or punitive damages (including without limitation lost profits) relating to the Service or otherwise relating to these Terms of Use (whether for breach of contract, tort, or negligence) or their termination, regardless of whether Affitu has been advised of the possibility of such loss. The limitations set forth in this section will apply even if an exclusive or restricted remedy fails.
Indemnification:
  • You agree to indemnify, defend, and hold Affitu, and our officers, directors, employees, and agents (collectively, the "Indemnitee") harmless from and against any and all losses, costs, expenses (including reasonable outside attorneys' fees), claims, suits, and liabilities by third parties (collectively, "Claims") that the to (I) any infringement of a third party's intellectual property or other rights; (II) any governmental, regulatory, or judicial authority's laws or regulations arising from your use of the Service; (III) your violation of these Terms of Service; or (iv) your actual or alleged gross negligence or willful misconduct in connection with your use of the Service.
Governing Law; Jurisdiction:
  • These Terms of Service will be governed by Indian law, without regard to any jurisdiction's choice or conflict of law rules. In the event of disputes, lawsuits, claims, or causes of action arising out of this Agreement, the courts in Bengaluru will have exclusive jurisdiction. Regardless of anything else in this agreement, Affitu is free to bring legal action in any court or tribunal in any jurisdiction other than Bengaluru that it deems appropriate and convenient in its sole discretion.
Waiver and Severability:
  • Any failure or delay by either party in exercising any right or remedy under this Agreement will not be construed as a waiver of that or any other term. If any provision of these Terms of Use is found to be unenforceable or invalid by a court of competent jurisdiction, such unenforceability or invalidity will not render these Terms of Use unenforceable or invalid as a whole, and the unenforceable provision will be construed to reflect the invalid or unenforceable provision's intentions as closely as possible.
Changes to the Service:
  • Affitu maintains the right, without previous notice or obligation, to change or modify the organization, structure, features, price, or "look and feel" of the Service and any portion thereof at any time.
Modification to Terms:

Affitu maintains the right to change the terms of these Terms of Service at any time by posting an updated version of this agreement; however, no such change will be effective retroactively.

No modification or amendment to the Terms of Use, and no waiver of any rights thereunder, will be valid unless in writing signed by the party to be charged, save as provided in this paragraph or elsewhere provided in the Terms of Use.

Prohibited Transfer:

You may not assign or transfer your Affitu account or any of your rights under these Terms of Use to any third party without our prior written authorization, which we may withhold for any reason/no reason.

Any attempted assignment or transfer that violates the following would be considered a material breach of the Terms of Use.

Copyright Policy

Affitu values other people's intellectual property and expects its users to do the same. You can e-mail us your Notification of Alleged Copyright Infringement at support@dotmite.com if you believe your own copyrighted work is accessible on the App in violation of your copyright.
